🗳️ Decoding the Electoral Tensions: ECI’s Counter-Affidavit Explained

A quiet yet significant legal battle is unfolding — and it might reshape how we understand voter eligibility and electoral fairness in India.

The Election Commission of India (ECI) recently submitted a counter affidavit in the Supreme Court defending its Special Intensive Revision (SIR) of electoral rolls in Bihar. While on paper this might sound like routine updating of voter lists, the real story is far more layered.

At the heart of the issue lies Article 324 and Article 326 of the Constitution — empowering the ECI to supervise and update electoral rolls. This power is operationalized through the Representation of People Act, 1950, particularly Articles 16, 19, 20, and 21 of the Act.

But here’s where the controversy begins:

▶️ What changed?
The SIR now demands additional documentation for voters added after 2003. If you're on the list before 2003, no new proof is required. But if added later, you must provide multiple identity documents.

▶️ What’s the problem?
Documents like Aadhaar and ration cards, which are most commonly held by ordinary citizens, are no longer accepted. Aadhaar, although widely used, is not considered proof of citizenship. And rural citizens often don’t have passports, birth certificates, or caste certificates.

▶️ What’s at stake?
While the aim is to remove duplication and ineligible voters, legitimate voters may end up being excluded, especially with this revision happening just months before Bihar’s election. And that’s a red flag for democracy.

▶️ Legal vs. Ethical?
Sure, the ECI is acting within its legal mandate. But is the timing, documentation requirement, and lack of clarity justifiable when millions risk disenfranchisement?

As the Supreme Court takes up this case, it’s important we understand the text and the context. Because this isn’t just a procedural update — it’s about who gets to vote in the world’s largest democracy.
